Bankruptcy can do many things, but there are some things that bankruptcy cannot accomplish. First of all, there is a general rule that applies in bankruptcy and outside of bankruptcy: If you want to keep your possessions, then you must continue to pay for your possessions. So, if you want to keep your house and your car, then you must continue to pay for them. The next biggest hurdle is that bankruptcy will not discharge certain types of debts that are singled out by the U.S. Bankruptcy Code for special treatment. The most notable types of debts that get this special treatment include child support, alimony, certain other debts related to a divorce, student loans, court restitution orders, criminal fines, debts incurred as a result of fraud or misrepresentation, and some types of taxes. The other thing that bankruptcy cannot do is have any affect on debts that were incurred AFTER the filing of the bankruptcy case. The filing of the bankruptcy case is a line drawn in the sand. The bankruptcy addresses debts that arose before the line in the sand, but debts that arise AFTER the line in the sand are NOT AFFECTED by the bankruptcy case.
